Our offerings include, but are not limited to:

3. Use of Third-Party Platforms

Our services rely on third-party platforms, applications, and tools. Any changes, disruptions, or discontinuations by these third parties may impact our ability to provide services.

You understand and accept that we are not liable for any loss or damage resulting from issues related to third-party platforms. Use of these third-party services may also be governed by their own terms and privacy policies, which you are responsible for reviewing and following.

When using our services, you agree to:

  • Provide accurate and up-to-date information necessary for the development and deployment of your live chat or AI chatbot solution.
  • Comply with all applicable laws and regulations in your jurisdiction, including privacy, data protection, and consumer rights laws.
  • Ensure you have the appropriate rights or permissions for any content or data you provide.
  • Use our services only for lawful purposes and in ways that do not cause harm, disruption, or deception.

5. Compliance with Local Laws

You are solely responsible for ensuring that your use of our services complies with the laws and regulations of your country or region. While ConverseIQ operates in good faith, we do not guarantee compliance with laws outside of Australia.

6. Intellectual Property

All chatbot designs, configurations, code, and materials created by ConverseIQ are our intellectual property unless we specifically agree otherwise. You may not copy, distribute, or use our intellectual property without our written permission.

Any content you provide to us remains your property.

7. Payment and Fees

Fees for our services will be outlined in your service agreement or invoice. Payments must be made according to the terms specified.

If payments are late or not received, we may suspend or deactivate your live chat or AI chatbot services until full payment is made.

8. Data Privacy and Security

We follow applicable Australian data privacy laws to protect information collected or processed through our live chat and AI chatbot services.

You are responsible for complying with relevant privacy regulations in your own region regarding any data you collect or process using our platform.

9. Limitation of Liability

ConverseIQ is not liable for:

  • Service interruptions or errors due to third-party platforms.
  • Losses arising from user misuse of chat services.
  • Unauthorised access to or misuse of your chat solutions.

We are also not liable in the event that any proprietary or third-party platform we rely on ceases to exist or operate, which may affect your access to our services.

Our total liability is limited to the amount you have paid for our services in the six (6) months prior to the event giving rise to the claim.

10. Platform Availability and Client Use

Our services depend on the continuous availability of third-party platforms and digital infrastructure. While we aim to provide reliable services, we do not guarantee uninterrupted access or that our platform will meet all your or your clients' requirements.

If you resell or provide access to our services to your clients, you do so at your own risk. You are responsible for managing those client relationships and ensuring their compliance with all applicable laws and these Terms.

ConverseIQ is not responsible for any issues, losses, or disputes arising from how your clients use our services or any service interruptions they may experience.

11. Force Majeure and Service Dependencies

We are not responsible for delays or failures in service due to events beyond our reasonable control, including but not limited to natural disasters, government actions, internet outages, infrastructure failures, labour disputes, or third-party service disruptions.

Our platform and ecosystem rely on a range of integrated third-party and proprietary systems. Any discontinuation, modification, or failure of these systems, whether under our control or not, may affect the delivery or performance of our services.

You acknowledge that such dependencies are an inherent aspect of using our platform, and we are not liable for any resulting unavailability.

12. Termination

We may suspend or terminate your access to our services if you breach these Terms or fail to meet payment obligations. All outstanding fees will become immediately due upon termination, and your services may be deactivated.

13. Privacy

Your use of our services is governed by our Privacy Policy, which outlines how we collect, store, and protect your information.

14. Changes to These Terms
